SAN JOSE – A 28-year-old man with a history of mental problems was arraigned in Santa Clara County Superior Court today on murder and attempted murder charges in the stabbing deaths of his mother and 1-year nephew and injuries to his 3-year-old niece.

Ruben Ramirez, of San Jose, alternately shielded his face from news cameras and conferred with his public defender as Judge Phili Pennypacker set a plea hearing for July 8 to the give his attorney time to review evidence in the case.

The judge ordered that Ramirez remain without bail in the Santa Clara County Jail system, which, according to Ramirez’s public defender Kelley Kulick, has classified him as suffering from mental health problems.

Ramirez faces two counts of murder, one count of attempted murder with a knife and special circumstances involving a double murder, making him eligible for the death penalty or life imprisonment, Deputy District Attorney Matt Braker said.

“His mental state is one of many factors,” Braker said after the hearing. “There is a lot about the defendant that needs to be found out.”

Kulick, who noted that the news media had reported details about Ramirez’s mental health history, said her defense would include obtaining an “understanding of who he is and how he got to this point.”

“Our hearts go out to the entire Ramirez family,” Kulick told reporters. “This is a horrible tragedy.”

Ramirez allegedly fled the scene of a brutal stabbing attack in San Jose on Wednesday that killed his 48-year-old mother and 1-year-old nephew and wounded his 3-year-old niece, according to the Santa Clara County Sheriff’s Office.

Ramirez’s mother was babysitting the infant boy and 3-year-old girl, who were her grandchildren, in a residence on Viewmont Avenue near Alum Rock Avenue shared by several generations of family members, deputies said.

A family member made an emergency call at 3:38 p.m. after entering the home and discovering three people inside suffering from stab wounds.

Emergency responders pronounced the woman and the boy dead at the scene. The 3-year-old, who was taken to a hospital, survived the assault.

The family member who found the victims reported seeing Ramirez at the home earlier in the day but he was not there when the family member returned.

Deputies, who learned that Ramirez might have traveled to San Francisco, notified officials from the San Francisco Police Department and the U.S. Marshals Service who found and captured Ramirez in that city.

In recent years, sheriff’s deputies were called to answer several emergency complaints involving Ramirez from his family’s home in unincorporated San Jose.

One call occurred on Oct. 18, when the family alleged he had attempted to break down a door, deputies said.

Deputies trained in crisis intervention for people with mental illnesses responded and transported Ramirez to a mental health facility at least once for treatment, deputies said.

Former U.S. Open champion Ken Venturi has died just 12 days after he was inducted into the World Golf Hall of Fame. He was 82.

His son, Matt Venturi, says he died Friday afternoon in a hospital in Rancho Mirage, Calif. Venturi had been hospitalized the last two months for a spinal infection, pneumonia and an intestinal infection.

Venturi was all about overcoming the odds. He won the 1964 U.S. Open at Congressional despite playing with severe dehydration. He overcame a stuttering problem as a kid in San Francisco to spend 35 years in the broadcast booth with CBS Sports. He also was the Presidents Cup captain in 2000.

Venturi was inducted into the Hall of Fame on May 6.

OAKLAND – A body retrieved from a truck that went into the water off of a street in West Oakland this afternoon was that of a local longshoreman who had worked at the Port of Oakland for more than 50 years, a co-worker said.

The truck went into the water shortly after 1:35 p.m. near the 2800 block of Seventh Street.

The truck was apparently knocked into the water by some sort of machinery and the man was underwater for more than 30 minutes before port divers could reach the vehicle and retrieve the body, Oakland fire Battalion Chief Coy Justice said.

The truck has also since been retrieved from the water, Justice said.

The man’s name has not yet been released by the Alameda County coroner’s bureau, but a co-worker said he was a 79-year-old man who had worked at the port for more than five decades.

“He’s a very loved man, he’s like a father to all of us,” said Frank Gaskin, a business agent with International Longshore and Warehouse Union Local 10.

Gaskin said work will shut down at the port until Saturday in honor of the employee and while authorities investigate the incident.

SACRAMENTO – The state’s independent budget analyst says California will take in $3.2 billion more than Gov. Jerry Brown estimated, providing Democratic lawmakers the opportunity to increase spending.

The Legislative Analyst’s Office released its assessment of Brown’s budget revision on Friday, just days after the governor’s revised budget. It said the administration’s figures do not reflect the improving economy, including higher capital gains from stock sales.

Assembly Speaker John Perez says no one should interpret the number “as an automatic green light to increase spending.” But he says there is strong pressure from Democratic lawmakers and advocates to restore past program cuts.

Brown proposed a $96.4 billion spending plan for the fiscal year that starts July 1. He wants to funnel more money to K-12 schools but limit state obligations.

SAN FRANCISCO – San Francisco police and other city departments are preparing for the 102nd Bay to Breakers race on Sunday with added security measures following the bombings at the Boston Marathon last month.

Backpacks or other bags larger than 8.5 inches by 11 inches by 4 inches will be banned from the 12K course, which spans from downtown San Francisco to Ocean Beach on the western end of the city.

Bomb technicians and canine units from the Police Department will be located along the course while police will also monitor cameras in real-time at the start and finish lines and at a hilly location along Hayes Street where crowds often gather for the race, police Chief Greg Suhr said.

A total of 17 law enforcement agencies, including the FBI, are contributing resources to ensure the safety of runners and spectators, Suhr said.

The city’s Department of Public Works has also been replacing regular trashcans along the course with transparent ones so authorities can make sure nothing suspicious has been placed inside, Suhr said.

Organizers of Bay to Breakers, which is presented for the first time this year by the classified ads website Craigslist, are reimbursing all costs for law enforcement, Suhr said.

Race director Angela Fang said, “We’re going to have the same great event that this city loves.”

Matt Stiker, chief marketing officer of the San Francisco Travel Association, called Bay to Breakers a great example of the quirkiness of San Francisco.

The race is famous for the zany costumes worn by its participants, as well as the occasional runner wearing nothing at all.

Stiker said the race is “a pressure release valve” for hard-working San Franciscans and “this city blows off steam like no one else does.”

One costumed contestant will be Tom Sweeney, who has been a doorman at the city’s Sir Francis Drake Hotel for 37 years and is running Bay to Breakers for the 40th time.

Sweeney has run the race for the past 15 years in his 40-pound beefeater outfit similar to the ones worn by guards at the Tower of London.

“It’s not your everyday running outfit but I love the challenge,” he said.

Sweeney is a native of San Francisco’s Sunset District and grew up with Suhr, even briefly dating the police chief’s sister.

He said he is always cheered on by his friends and other supporters when he runs the race.

“It’s great, seeing all my friends,” he said. “I look forward to this day every year.”

Sweeney said he wasn’t concerned about his safety in the wake of the Boston bombings, which killed three people and injured more than 200 others near the race’s finish line in April.

“I think it will be the safest thing ever,” he said. “Boston was unique but I think in San Francisco, everyone comes together. It should be a good year.”

Olympian Ryan Hall, who holds the fastest marathon time ever run by an American, will be participating in the Bay to Breakers for the first time this year. Tesfaye Alemayehu, an Ethiopian who trains in Antioch and has three top-five finishes in the San Francisco race, is among other top competitors.

The race starts at 7 a.m. Sunday at Howard and Main streets and will affect San Francisco Municipal Railway bus lines along the course.

More than 25 Muni routes will be affected, including the F, N, 2, 5, 6, 8X, 9, 10, 12, 14, 14L, 18, 19, 21, 22, 24, 27, 28, 29, 30, 31, 33, 38, 43, 44, 45, 47, 49, 71 and 108 lines.

The Great Highway parking lot closed at 6 a.m. Thursday in advance of the event, while dozens of other streets will be closed shortly before and during the race.

A list of street closures and other information about the event can be found online at www.baytobreakers.com.

CASTRO VALLEY – An Alameda County sheriff’s deputy shot a suspect who was trying to flee following a traffic stop near an Interstate Highway 580 on-ramp in Castro Valley on Thursday night, a sheriff’s spokesman said today.

The shooting was reported at about 11:15 p.m. near the Castro Valley Boulevard on-ramp to westbound Highway 580.

Deputies pulled over a Buick that had a stolen license plate from a Honda on it. After the car stopped, the driver tried to flee on foot but was tackled by deputies, sheriff’s spokesman Sgt. J.D. Nelson said.

A passenger in the rear of the car then got into the driver’s seat and tried to drive away. He began to struggle with a sheriff’s deputy, prompting another deputy to open fire, striking the suspect in the torso, Nelson said.

The suspect was taken to a hospital where he was in critical condition as of this morning, according to Nelson.

A female passenger in the car was uninjured in the incident and was also taken into custody, Nelson said.

The names of the suspects were not immediately available, Nelson said.

SAN JOSE – More than 100 professional cyclists are poised today to begin a 20-mile trek through San Jose in the sixth stage of the 13th annual Amgen Tour of California, which will prompt some street closures in the city for much of the afternoon.

The cyclists began the 750-mile race up the California coast last Sunday in what is regarded as the largest cycling event in the country, according to the Amgen tour’s website.

Jens Voigt of Germany won the fifth stage that ended Thursday near San Luis Obispo. The race ends in Santa Rosa this Sunday.

The San Jose leg of the race commences at about 12:30 p.m. at the IBM Silicon Valley Lab at 555 Bailey Ave. in the Almaden area of south San Jose.

The entire 20-mile route through San Jose will be closed to auto traffic for racers from noon until 4 p.m., according to San Jose police.

The route moves west on Bailey Avenue then heads south onto McKean Road, then to Uvas Road, Oak Glen Avenue and Willow Spring Road, then turns north on Hale Avenue to Santa Teresa Boulevard.

The cyclists then take a right back onto Bailey, a left to Malech Road and head east on Metcalf Road and finish up at the Santa Clara County Motorcycle Park at 300 Metcalf Road.

The California Highway Patrol will accompany the cyclists and make every effort to assist motorists, residents and businesses along the route, police said.

The U.S. Highway 101 on- and off-ramps to Bailey Avenue will also be shut off to traffic, police said.

OAKLAND – Two men who apparently were Golden State Warriors fans were killed after the basketball team’s playoff game Thursday night when a gunman opened fire on their Porsche on Interstate Highway 880 in Oakland, authorities said.

The victims were traveling north on Highway 880 in the slow lane near the Jackson Street exit when someone in a dark-colored SUV fired several shots into their car at 10:36 p.m. Thursday, California Highway Patrol spokesman Sam Morgan said.

Morgan said the victims’ Porsche swerved and slammed into a guardrail and then veered across lanes of traffic. The man in the passenger seat was ejected or fell out of the car and was hit by another vehicle, possibly a box-style truck, he said.

The driver of that vehicle did not stop but may not have known that the vehicle struck the man, Morgan said.

Both men were pronounced dead at the scene.

Both victims were shot and it is believed that both were killed by the gunfire, but an autopsy will determine if the subsequent injuries suffered by the passenger contributed to his death, Morgan said.

He said authorities would like to talk to the driver of the vehicle that struck the passenger.

Both victims were wearing yellow T-shirts similar to those worn by thousands of Warriors fans at the team’s NBA playoff game against the San Antonio Spurs Thursday night and Warriors tickets were also found at the scene of the shooting, Morgan said.

The Warriors lost to the Spurs in Thursday’s game and were eliminated from the playoffs.

Morgan said police don’t have a description of the shooting suspects as of late this morning.

The shooting victims have tentatively been identified but authorities aren’t releasing their names until their identities have been confirmed by the Alameda County coroner’s bureau and their families have been notified, Morgan said.

The shooting shut down all lanes of northbound Highway 880 and the Jackson Street on-ramp until shortly after 2:30 a.m. today.
